User by acceptance and continued use of this internet access account with US in Touch Inc., understands and agrees to the following terms and conditions.
1. All provisions of the service agreement are non-transferable and the sole responsibility for the user including confidentiality of passwords. User agrees not to resell or otherwise pass through onto others any access to US in Touch Inc. through users account.
2. User agrees not to use the internet for any form of commercial advertising in any manor considered inappropriate including but not limited to cross-posting articles to unrelated or multiple usenet newsgroups and mailing of any unsolicited advertisement commercial offers. No links to copyrighted material and no software archives of copyrighted material. User agrees to abide by the acceptable standards concerning internet polices and discard for these polices may be cause for cancellation of access.
3. User is prohibited from any commercial activity including selling, advertising, promoting of any product or service unless user has signed this agreement under a business account. No adult content will be hosted without approval of a written request. The definition of adult content is at the discretion of US in Touch Inc..
4. Services are provided on a (As Is) basis with out warrantee of any kind, expressed or implied, including but not limited to warranties of merchantability or fitness for purpose. US in Touch Inc. shall not be liable for any damages whatsoever arising out of access to or inability to gain access to services.
5. User is responsible to pay the provider (US in Touch Inc.) all charges
relating to the use of users account. All payments are to be made in Advance
and Provider reserves the right to cancel or suspend access of service for
accounts which are delinquent, or for non-compliance with any of the terms
of this agreement. Users who are terminated or suspended for any violation
of this agreement are still responsible for charges then due and payable.
All cancellation requests must be made in writing and sent via US Mail to
US in Touch Inc. 1840 East Calvada suite 6 Pahrump NV 89048. Cancellation
will not take effect until received. Current month fee are neither refundable
nor prorated. 6. Provider is not responsible for any loss nor damage of
user’s files residing on the provider’s server and user accepts
total responsibility for any and all information, software no any material
received, accessed, downloaded or viewed from the use of this service.
7. Users of this system must be at least 18 years of age or provide signed
parental permission.
8. Any part of this agreement, which is found to be unenforceable or invalid, shall not have any force or effect on the remainder of this agreement and the parties agree to accept and abide by the remaining terms and conditions stated herein. In the event the user defaults on any part of this agreement, the user agrees to pay any reasonable collection, legal, attorney, or court fees necessary for provider to correct the default.
9. Provider may at it’s sole discretion, sell, assign, or transferable its rights and ownership of this agreement without notice.
10. The provider offers unlimited dial up internet access under the terms of this agreement, however the dial up connections are not intended to be dedicated full time connections and will be disconnected after 20 minutes of inactivity. User agrees not to use any automatic method to avoid this inactivity detection and agrees to keep the connection active only when actually using it.
11. User is responsible for any and all local and long distance chargesmade in connection with the service provided.
